The legal unit at the College of Nursing was promoted to the level of a division to include 25/7/2023 on 3297, according to the administrative order with the number MAT / two administrative units, namely: The Legal Counseling Unit and the Rights and Claims Unit.
The Legal Division is responsible for supervising all legal work and issues, providing legal advice and litigation in cases in which the College of Nursing in its legal capacity or one of its affiliates is a party, as well as participating in internal committees in the college or even formed at the level of Baghdad University, in which the presence of legal opinion is required.
The aim of establishing the Legal Division is to ensure the application of the law in all legal matters and facts that accompany the academic and administrative scientific process of the educational institution on the one hand, and on the other hand, to ensure the rights of the college’s affiliates within the framework of the laws in force that govern their employment relationship with it.

Legal Division

It is the division that supervises all legal works and cases, prepares investigative and audit committees, guarantees and agencies of all kinds, and also pleads in the college’s cases before the competent courts, and the division is divided into two units: –
– Legal Counseling Unit
– Rights and Litigation Unit

Duties of the Director of the Legal Division

  1. 1.  Expressing opinion and advice on legal matters.
    2. Preparing and studying draft laws related to the university and the Ministry of Higher Education and Scientific Research, and expressing opinions on them.
    3. Auditing contracts related to the college and expressing an opinion on the contracts presented to the division by the college and approving contracts of all kinds.
    4. Representing the college in front of the courts and the competent judicial authorities.
    5. Follow up on the mechanism of distributing and allocating lands and housing units for the ministry’s college affiliates and then contacting the university / legal affairs department.
    6. Contributing to the committees that require legal membership, including (general inventory of the college – inventory of war damage – promotion and allowance – salary determination – accountability and justice committee – political dismissed committee – deletion committee – student discipline committee – bidding committees – contributing to the number of committees that are referred to the legal division for investigation and audit and then implementing the recommendations of the committee).
    7. Any other work assigned to the division by the deanship of the college or the university presidency.

Duties of staff working in the Legal Division

  1. Organize the division’s inbound and outbound work.
    2. Editing correspondence related to the work of the college and answering inquiries from the university and other related formations.
    3. Organizing guarantees, agencies and undertakings related to the work of the division.
    4. Keeping and archiving the division’s mail.
    5. Prepare all the necessary priorities with the official mail.
    6. Promoting the transactions of guarantees and pledges related to the college and as shown below:-
    – Guarantees referred to the Legal Division (guarantees for undergraduate and postgraduate students (employee and non-employee), guarantees for affiliates enjoying study leaves inside the Republic of Iraq, loan guarantees for teachers and employees) and all types of guarantees.
    – Pledges for employees (maternity leave, five-year leave, long vacations, early retirement)
    – Pledges for students (graduate studies, undergraduate studies)
    – Pledges of accountability and justice.
        7. Agencies for the receipt of salaries for college employees.
       8. Exporting the clearance of college employees (transfer, placement, long leave)

Units that make up the Legal Division

The Legal Division consists of the following units: –
1. The Rights and Litigation Unit, and the employee in this unit represents the college before the competent courts.
2. The Legal Consultation Unit and the employee in this unit indicates the opinion required of him by the departments and divisions of the college and answers oral and written legal inquiries.

The work and tasks assigned to the Legal Division

  1. Representing the college in the competent courts in every right for it or against it and attending the police stations in every matter that requires it and initiating civil and criminal proceedings, especially against fraudulent students.
    2. Representing the college before the Integrity Commission in all its branches for the purpose of recording statements against fraudulent students and those claiming to be graduates of our college.
    3. Auditing the contracts that are referred to the Legal Division and stating the opinion on them and then approving them.
    4. Following up on matters related to political dismissed persons, notifying them of the decisions of the Political Dismissed Persons Committee at the Ministry and the Verification Committee at the Council of Ministers, and responding to the letters received against them.
    5. Conducting the notifications received against the college’s affiliates, whether from the courts, enforcement departments or other state departments.
    6. Participating in the work of committees, preparing minutes and keeping their priorities, including these committees:
    – All investigative committees
    – Audit committees
    – Technical Committees
    – Student Discipline Committee
    – Student Transfer Committee
    – Salary Scale Committee
    – Committee for Opening and Analyzing Bids for Tenders submitted to the College
    – Damage Determination and Assessment Committee
    – College Stores Inventory Committee
    – Bidding Committee for College Sites
    – Committee for Sale and Lease of State Funds
    – Promotions Committee
    – Providing legal advice to all the college’s formations whenever requested, stating the legal opinion on the matters presented to them, and providing them with the instructions and laws they request in support of the legal opinion.
    – Editing and printing books related to legal work and in all the above-mentioned matters, and memorizing the instructions and laws issued in the Iraqi Chronicle.
